4K Aluminum Limited Warranty

4K Aluminum Inc., Las Vegas, Nevada (hereinafter “4K”) provides the following limited material warranty for 4K Pergola Systems and 4K Pergo-Soleil. Subject to the conditions and limitations listed herein, 4K Aluminum Inc. (hereinafter “4K”) warrants 4K Pergola Extruded aluminum products and 4K Pergo-Soleil panels to befree from material defects in quality and materials. This limited warranty covers the quality of artistry and materials for 20 years from the date of installation. This limited warranty is void if the warranted good is moved from the location listed on the warranty certificate and covers only regular and proper use. This limited warranty does not cover damage caused by misuse.

 

This warranty extends only to the original purchaser and is non-transferable. This warranty does not cover the cost of installing any product, the cost of removing or disposing of any product, or the cost of installing any replacement product furnished under the terms of the warranty. 4K does not warrant or guarantee that any aluminum parts provided under this limited warranty will match the originals in color or pattern. 4K reserves the right to discontinue or modify any product line or color without notifying the original purchaser. If the original product is unavailable, we retain the right to provide replacement material of equal value or quality.

 

The coverage of this warranty only covers products used on a residential or commercial property where the owner resides during the original owner’s occupancy. The warranty period for products installed on property that is not residential property where the owner resides, including but not limited to schools, condominiums, apartment buildings, and rental property – or on property owned by other owners, including but not limited to corporations, government agencies, partnerships, trusts, religious organizations, and cooperatives will be twenty (20) years following the installation of the aluminum products and is limited to the original owner (non-transferable).

 

Either Jotun International or AkzoNobel provides the powder coat warranty, which is a 20-year warranty against flaking and fading. The warranty is limited to material replacement, not installation labor, if any.

 

4K Aluminum Wood Sublimation powder coat warranty provides a 10-year warranty. The Wood Sublimation warranty is not valid if:
‍

1. Damages to the Coated Materials caused by installation; or 

2. Damages to the Coated Materials caused by scratching or rubbing after installation or 

3. Damages to the Coated Materials from the cut edges exposed to the outdoor atmosphere and if the joint sealer is not applied to all exposed cut edges or 

4. Cleaning and maintenance are not carried out as recommended in our 4K Aluminum Care & Maintenance Instructions, which can be found on our 4K Aluminum website.

The Wood Sublimation 10-year warranty is limited to material replacement, not installation labor, if any; 4K Aluminum will authorize the direct replacement upon inspection of the defective material.

 

4K Aluminum’s Motorized Louver Systems Actuator has a 2-year warranty against electrical defects, limited to material replacement, not installation labor, if any. 4KAluminum’s Motorized Louver Systems electrical box has a 2-year warranty against electrical defects, limited to material replacement, not installation labor, if any. 4K Aluminum will authorize the direct replacement upon inspection of the defective material. 4K Aluminum does not offer a warranty against any batteries used within 4Ks Motorized Louver Systems.

 

Any lighting sold by 4K Aluminum will only carry the manufacturer's warranty. 4K Aluminum will not extend a warranty for lighting. 4K Aluminum is not responsible for material replacement or installation labor costs if lighting needs to be replaced. Therefore, 4KAluminum need not authorize the direct replacement upon inspection of the defective material.

 

Exclusions

‍

4K shall not be liable for, and this warranty does not apply to any failure, defect, damage, or expense resulting from or connected with the following:

 

Installation or handling of products, once removed from our facility, including any lack of performance or improper performance in any way by the contractor or other installer;

 

Abnormal use of the products;

 

Heat or radiation;

 

Corrosion caused by environmental factors such as salt, chemicals, or other corrosive atmospheric conditions not related to 4K Aluminum's manufacturing process is not covered under this warranty;

 

The use of any product not manufactured by us;

 

Labor, transportation, or installation costs; color changes due to weathering or aging if the color change is even and equal when exposed to the same or similar sunlight and other environmental conditions because weathering will cause any colored surface to gradually lighten, darken, chalk, or accumulate dirt or stains (the severity of these conditions depends on air quality, the geographic location of the property, and other local conditions over which 4K has no control);

 

Anyone or anything other than 4K, including without limitation weathering, oxidation, mold, mildew, settling of the building, failure of the structure (including foundations and walls), use of incompatible accessories, fire, flood, lightning, ice, wind-borne objects, earthquake, hurricane, sun, cyclone, gale, tornado, the weather of a catastrophic nature, acts of God, intentional acts, unreasonable use, misuse, physical abuse, vandalism, riot, insurrection or civil disorder, accidents, or corrosive atmospheres (such as those contaminated by acid rain, harmful chemicals, or vapors), or other defects not caused by 4K; or ordinary wear and tear.

Warning Regarding Proposition 65

The State of California knows some materials and products provided by 4KAluminum Inc. contain chemicals that cause cancer, congenital disabilities, or other reproductive harm. (California law requires this warning to be given to customers in the State of California.)

 

Claims and Remedies

‍

A claim under this warranty must be reported in writing, with proof of purchase, to 4KAluminum, Inc., 5280 S. Valley View Blvd Ste I & J, Las Vegas, NV 89118,within thirty (30) days of the date that the defect is first discovered or reasonably could have been discovered. 4K will then have a reasonable time to inspect or, at 4K’s option, to have the product shipped at the owner’s expense, prepaid, to 4K to examine the alleged defect.

 

4K shall be the sole judge of whether the product is defective and whether the defect is due to manufacturing. If, after its inspection, 4K determines the claim is in accordance with the terms of this Limited Warranty, then 4K will, at its option, replace the defective section or part or provide a refund according to the following schedules:

 

Theresidential property where the owner resides (limited to the original owner)‍

 

0 to 15 years, the total purchase price of products.

 

15 to 20 years, 50% of the purchase price of products.

 

All other owners and uses (limited to original owner)

 

0 to 15 years, the total purchase price of products.

 

15 to 20 years,50% of the purchase price of products.

 

The preceding express warranty excludes all other express warranties. 4kaluminum.com implied warranty, including any warranty of fitness for a particular purpose or of merchantability, is limited in duration to the duration of the express warranty contained in this warranty document unless a shorter period is permitted bylaw. In no event will 4k be liable for any special, indirect, incidental, or consequential damages arising out of breach of this warranty or the purchase, installation, ownership, or use of 4k aluminum inc. your exclusive remedy and4k’s exclusive liability for any breach of warranty is limited to what appears in this document.

 

Some states do not allow limitations on how long an implied warranty lasts or the limitation or exclusion of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific rights, and you may have other legal rights which vary from state to state.

 

This warranty shall only be applicable & enforceable in the United States of America.
