Terms of Service

4K Aluminum designs and supplies aluminum outdoor structures, including pergolas, louvers, cantilevers, roof systems, fencing, decorative panels, lighting, and architectural features.

4K Aluminum sells only to authorized, properly licensed contractors. We do not sell to the general public. The Site is provided for informational purposes. Nothing on the Site is an offer to sell products to any person. All product sales are made to authorized contractors under separate agreements, and pricing, quotes, and installation are provided by those contractors.

We work to keep product information on the Site accurate and current. However:

• Product specifications, dimensions, spans, options, finishes, colors, and availability may change at any time without notice.
• Specifications and load information on the Site are for general reference only. We recommend site-specific engineering for every project, and every structure must comply with local building codes and permit requirements. Final design and engineering are determined for each project.
• Colors and finishes shown on screen may differ from actual product colors. Contact an authorized 4K contractor to view physical samples before making a selection.
• Project photos are for illustration and may show options, accessories, landscaping, or features that are not part of every installation. Some photos may be digitally enhanced for quality; the projects shown are real installations of 4K products.

Product warranties are provided only through the written 4K Aluminum Limited Warranty, available on our Warranty Information page. Nothing on the Site creates any additional warranty, guarantee, or obligation. If anything on the Site conflicts with the written Limited Warranty, the Limited Warranty controls.

Submitting a Contractor Interest Form does not guarantee approval, does not create a business relationship, and does not grant any right to purchase, sell, or install 4K products. Onboarding is subject to the availability of open spots in each region, our review and vetting process, and our licensing requirements, and the decision to onboard new contractors is at 4K Aluminum's sole discretion.

Access to and use of the 4K contractor ordering portal is governed by separate account terms and contractor agreements, not by these Terms.

When you submit information through the Site, including contact forms, commercial project inquiries, uploaded plans or drawings, Contractor Interest Forms, or warranty registrations, you agree that:

• The information you provide is accurate and complete.
• You have the right to share anything you upload, and it does not violate anyone else's rights.
• 4K Aluminum may use your submission to respond to your request, review your inquiry or application, connect you with an authorized 4K contractor, and support our products and services, as described in our Privacy Policy.

Please do not submit confidential or sensitive information beyond what a form requests.

The Site and its contents, including text, photographs, graphics, logos, product names, designs, documents, and software, are owned by 4K Aluminum or its licensors and are protected by copyright, trademark, and other laws.

4K Aluminum® is a registered trademark of 4K Aluminum Inc. You may not use the 4K Aluminum name or logo without our prior written permission.

You may view the Site and print or download pages for your personal or internal business use. You may not copy, reproduce, modify, distribute, republish, or create works based on Site content without our prior written permission.

Brochures, flyers, and other documents available on our Downloads page may be viewed, printed, and shared to evaluate or promote genuine 4K Aluminum products. You may not alter these documents, remove 4K Aluminum branding, or present them as your own material.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or fraudulent information, or impersonate any person or business
• Send spam or unsolicited messages through Site forms
• Attempt to gain unauthorized access to the Site, our systems, or other users' information
• Interfere with the Site's operation, including by introducing viruses or malicious code
• Use automated tools to scrape, copy, or collect content or data from the Site without our written permission

We may suspend or block access to the Site for anyone who violates these Terms.

The Site contains links to websites and services operated by others, including our contractor ordering portal, the Instagram feed on our About page, Billd, our engineering partners, Google Maps, Facebook, and Instagram. We do not control and are not responsible for their content, services, or privacy practices. Your use of third-party sites is at your own risk and subject to their terms.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, 4K ALUMINUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ITS CONTENT, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

This section applies to the Site only. Product warranties are governed solely by the written 4K Aluminum Limited Warranty. See also our Disclaimer.

TO THE FULLEST EXTENT PERMITTED BY LAW, 4K ALUMINUM AND ITS OWNERS, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

You agree to defend, indemnify, and hold harmless 4K Aluminum and its owners, officers, employees, and partners from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Site, your submissions, or your violation of these Terms or the rights of others.

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules.

Informal resolution first. If you have a dispute with 4K Aluminum arising from these Terms or your use of the Site, please contact us first at info@4kaluminum.com with a description of the dispute. We will try in good faith to resolve it within 30 days.

Binding arbitration. If we can't resolve the dispute informally, you and 4K Aluminum agree that it will be resolved by final and binding arbitration on an individual basis, instead of in court. The arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules, before a single arbitrator, and will take place in Clark County, Nevada, or by video or phone if the arbitrator allows. The arbitrator's decision may be entered as a judgment in any court with jurisdiction.

No class actions. You and 4K Aluminum agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not combine more than one person's claims.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may ask a court for an injunction to protect its intellectual property. Any dispute that is not subject to arbitration will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information.

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and 4K Aluminum regarding the Site.
